Welcome to Moti, an application operated by Motisha, a company registered in Tanzania. These Terms and Conditions ("Terms") govern your access to and use of the Moti mobile application and its related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
By creating an account, accessing, or using the Moti app, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and Motisha. If you are using the Service on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.
Moti is a technology platform that provides a range of on-demand services, including but not limited to ride-hailing, food delivery, grocery delivery, parcel delivery, shopping, pharmacy services, drinks delivery, electronics delivery, send parcelß and fashion delivery. The Service connects users with independent third-party providers ("Service Providers") who offer these services. Motisha does not provide transportation, delivery, or other services itself, and is not a transportation carrier. Our role is solely to facilitate the connection between users and Service Providers.
To access most features of the Service, you must register for and maintain an active personal user account. You must be at least 18 years of age, or the age of legal majority in your jurisdiction (if different from 18), to obtain an Account. Account registration requires you to submit certain personal information, such as your name, address, mobile phone number, and at least one valid payment method. You agree to maintain accurate, complete, and up-to-date information in your Account. Your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access and use the Service or Motisha’s termination of these Terms with you.
You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account username and password at all times. Unless otherwise permitted by Motisha in writing, you may only possess one Account.
Individuals or entities wishing to offer services through the Moti platform as Service Providers must register for a separate Service Provider account and meet specific criteria set by Motisha and relevant Tanzanian regulations. This includes, but is not limited to, providing vehicle registration details, driver's details (name and photo), and adhering to operational requirements as outlined by the Land Transport Regulatory Authority (LATRA) [1]. Motisha reserves the right to approve or deny Service Provider applications based on its internal policies and compliance with local laws.
You understand that use of the Service may result in charges to you for the services you receive from Service Providers ("Charges"). Motisha will facilitate your payment of the applicable Charges on behalf of the Service Provider as their limited payment collection agent. Payment of the Charges in such manner shall be considered the same as payment made directly by you to the Service Provider. Charges will be inclusive of applicable taxes where required by law. Charges paid by you are final and non-refundable, unless otherwise determined by Motisha.
Motisha reserves the right to establish, remove and/or revise Charges for any or all services obtained through the use of the Service at any time in Motisha’s sole discretion. Further, you acknowledge and agree that Charges applicable in certain geographical areas may increase substantially during times of high demand. Motisha will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or the amounts thereof.
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Service by any third party. Such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person, and the transmission of obscene or offensive content or disruption of the normal flow of dialogue within the Service.

The Moti app allows for trip cancellation. You will not be charged for a trip if it has not started or if the driver has not arrived at the pick-up point [1]. However, repeated or abusive cancellations may result in account suspension or termination at Motisha's discretion.
The Moti app will include a contact or emergency contact feature for user safety and support [1]. Users are encouraged to utilize this feature in case of any issues or emergencies during the use of the Service.
The Service and all rights therein, including intellectual property rights, are and shall remain Motisha’s property or the property of Motisha’s licensors. Neither these Terms nor your use of the Service convey or grant to you any rights:
The Service is provided "as is" and "as available." Motisha disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these terms, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. In addition, Motisha makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the Service or any services or goods requested through the use of the Service, or that the Service will be uninterrupted or error-free. Motisha does not guarantee the quality, suitability, safety or ability of Service Providers. You agree that the entire risk arising out of your use of the Service, and any service or good requested in connection therewith, remains solely with you, to the maximum extent permitted under applicable law.
Motisha shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the Service, regardless of the negligence (either active, affirmative, sole, or concurrent) of Motisha, even if Motisha has been advised of the possibility of such damages. Motisha shall not be liable for any damages, liability or losses arising out of: (i) your use of or reliance on the Service or your inability to access or use the Service; or (ii) any transaction or relationship between you and any Service Provider, even if Motisha has been advised of the possibility of such damages. Motisha shall not be liable for delay or failure in performance resulting from causes beyond Motisha’s reasonable control. You acknowledge that third-party service providers providing transportation services requested through some request products may offer ride-sharing or peer-to-peer transportation services and may not be professionally licensed or permitted.
You agree to indemnify and hold Motisha and its affiliates and their officers, directors, employees, and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys’ fees), arising out of or in connection with: (i) your use of the Service or services or goods obtained through your use of the Service; (ii) your breach or violation of any of these Terms; (iii) Motisha’s use of your User Content; or (iv) your violation of the rights of any third party, including Service Providers.
These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be settled by arbitration in Dar es Salaam, Tanzania, in accordance with the rules of the Tanzania Arbitration Centre.
Motisha reserves the right to modify these Terms at any time. If we make changes to these Terms, we will provide notice of such changes, such as by sending an email notification, providing notice through the Service, or updating the “Last Updated” date at the beginning of these Terms. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
